LJ Hooker Subiaco, Scarborough & Hopetoun Referral Program Terms and Conditions
Effective Date: 1st June 2025

These Terms and Conditions govern participation in the Referral Program (“Program”) offered by LJ Hooker Subiaco, Scarborough & Hopetoun (“the Agency”, “we”, “us” or “our”). By participating in the Program, you (“you”, “your” or “Referrer”) agree to be bound by these Terms and Conditions.

1. Eligibility

1.1 The Program is open to individuals who:

• Are aged 18 years or over;

• Are legal residents of Western Australia; and

• Are not prohibited from participating under applicable laws or regulations.

1.2 The following persons are not eligible to participate:

• Licensed real estate agents, sales representatives or brokers (as defined under the Real Estate and Business Agents Act 1978 (WA));

• Employees, contractors, agents or affiliates of LJ Hooker Subiaco, Scarborough & Hopetoun;

• Any individual or entity engaged in real estate marketing or commission-sharing arrangements in a professional capacity.
  
  

2. How the Program Works

2.1 A valid referral is one where:

• A Referrer submits the details of a potential property seller (“Referred Client”) using the Agency’s official Referral Form, before any direct contact is made between the Agency and the Referred Client;

• The Referred Client is a new client (i.e., has not previously engaged with or listed property with the Agency);

• The Referred Client enters into a valid exclusive sales agency agreement with LJ Hooker Subiaco, Scarborough & Hopetoun; and

• The property being listed and sold is located in Western Australia, and is successfully sold with the Agency acting as the exclusive listing agent.

2.2 Only the first Referrer to submit the referral (based on date and time of submission) will be eligible for the referral reward.

3. Referral Rewards

3.1 A successful referral entitles the Referrer to receive:

• $1,000 if the final property sale price is $700,000 or less; or

• $2,000 if the final property sale price is greater than $700,000.

3.2 The referral reward will be paid within 30 days of:

• The settlement of the property; and

• Receipt of the full sales commission by the Agency.

3.3 Payments will be made via electronic bank transfer to details provided by the Referrer.

3.4 Rewards are not transferable, assignable or redeemable for other forms of compensation.

4. Program Conditions and Limitations

4.1 Referrals are valid for a 12-month period from the date of submission. If the Referred Client has not completed a successful sale within this period, the referral reward will not apply.

4.2 Only one reward will be issued per Referred Client, regardless of the number of properties listed or sold.

4.3 Referrers may submit multiple referrals but may only be rewarded for eligible and successful transactions that meet the conditions outlined herein.

5. Taxation

5.1 Referral rewards may be deemed taxable income under Australian tax law. It is the sole responsibility of the Referrer to declare and pay any applicable tax liabilities.

5.2 LJ Hooker Subiaco, Scarborough & Hopetoun does not provide tax advice. Referrers should seek independent financial or taxation advice if needed.

6. Program Changes and Termination

6.1 We reserve the right to modify, suspend or terminate the Program or these Terms and Conditions at any time, without notice, at our sole discretion.

6.2 In the event of termination, valid referrals received prior to the termination date will be honoured, provided they meet all eligibility criteria.

7. Fraud, Misrepresentation and Abuse

7.1 Any attempt to manipulate, misrepresent or abuse the Program, including providing false or misleading information, will result in disqualification from the Program and forfeiture of any pending rewards.

7.2 We reserve the right to audit referrals and take legal action where necessary.

8. Governing Law

8.1 These Terms and Conditions are governed by the laws of Western Australia and any disputes will be subject to the exclusive jurisdiction of the courts of that state.

9. Acceptance

By submitting a referral through our Program, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions, including the requirement that the referred property must be located in Western Australia.
